Working With a Personal Injury Lawyer to Settle a Case or Claim Quickly

Law Blog

There are many different reasons you can hire a personal injury lawyer, but more often than not, you will need to find a lawyer if you are hurt or injured because of someone else's mistake. Finding the right lawyer to help you settle a claim with the insurance company or to file a suit for compensation is common, and there are things the personal injury lawyer can do for you that can help speed the process along.

Investigating the Incident

When you meet with the lawyer the first time, they will ask a lot of questions about your accident and how it happened. The point is to determine if there is a solid case before the lawyer determines if they will represent you.

Often, if they believe there is a case, the personal injury lawyer will start an investigation to dig up all the details and other information that can be used as evidence of your claim. If there is enough evidence, your lawyer will use the evidence to show the court who is at fault and solidify your claim.

You will probably need to meet with the investigator, but remember they are on your side, so help them all you can. Give them your story and any details that you feel are relevant to the case so they can dig into it and try to prove the case for you. The investigator will have an easier time if you are honest with them about the accident or injury and how it happened.

Insurance Negotiations

Before taking your case to court, your injury lawyer will want to meet with the lawyers from the insurance company and see if they can come to an agreement. If you have a strong case, a settlement may be proposed, and typically settling the case is more straightforward than having to go through a court trial.

Your lawyer will present the evidence and try to convince the other attorneys that they should settle out of court. If they agree to do that, there will be more meetings to determine the award, taking into account loss of work, pain, and bills that you have as a result of the accident.

Filing Suit

If the lawyers can not come to an agreement, the case will need to go to court, and the judge will determine the outcome of the case. The award that the court gives you may be about the same or maybe a little more than a settlement, but the fees to go to court are higher. In the long run, if the lawyers can settle the case out of court, everyone is better off, and the case is closed faster.

Choosing To Fight

Although I am far from perfect, I have focused on abiding by the local laws for the vast majority of my life. Unfortunately, about five years ago, I realized that I was being accused of a crime that I didn't commit. I thought about letting the trial run its course, but then I realized that fighting would be important to ensure my future. I teamed up with a great lawyer, and things became much easier overnight. My legal counsel told me what to do and what to avoid, and he was able to prove the facts in a court of law. This blog is all about choosing to fight charges.
